Please read these SMS Terms & Conditions carefully. By enrolling in, subscribing to, or otherwise agreeing to receive text messages from SunBiz Support, LLC, you agree to these SMS Terms & Conditions. If you do not agree, do not enroll in our text messaging program.
IMPORTANT CONSENT NOTICE
By opting in, you authorize SunBiz Support and service providers acting on our behalf to send recurring SMS or MMS messages to the mobile number you provided, including messages sent using automated technology. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to receive marketing text messages is not a condition of purchasing any goods or services.
1. Scope and Relationship to Other Terms
These SMS Terms & Conditions ("SMS Terms") govern text messages sent by or on behalf of SunBiz Support, LLC ("SunBiz Support," "we," "us," or "our") to the telephone number you provide. They apply to SMS, MMS, and similar mobile messages concerning appointments, inquiries, service delivery, account matters, business funding readiness, educational content, promotions, and other communications described below.

These SMS Terms supplement our general Terms & Conditions and Privacy Policy. If these SMS Terms conflict with our general Terms & Conditions on an issue specifically involving text messaging, these SMS Terms control for that issue. A separate signed or electronically accepted service agreement may contain additional terms governing the services you purchase.

2. SMS Program Description
The SunBiz Support text messaging program may be used to communicate with prospective clients, current clients, referral partners, vendors, and other persons who have provided a mobile number and appropriate consent. Text messages may be conversational, informational, transactional, or promotional, depending on your relationship with us and the consent you provided.

Enrollment in the SMS program does not create a client relationship, guarantee eligibility for funding, reserve an appointment, approve an application, or change any payment or service obligation unless we expressly confirm otherwise in writing.

3. Eligibility and Authority
You must be at least 18 years old and legally able to agree to these SMS Terms. By providing a mobile number, you represent that you are the subscriber, customary user, or authorized user of that number and that you are authorized to consent to receive messages at that number.

Our SMS program is intended primarily for telephone numbers assigned in the United States. Availability may vary by carrier, device, location, and service plan.

4. How You Enroll and Provide Consent
You may enroll or provide consent through one or more approved methods, including:

Checking an unchecked SMS consent box on a website, intake form, scheduling page, payment page, or other electronic form that contains the required disclosure.

Submitting a signed or electronically accepted agreement that contains SMS consent language.

Texting a designated keyword to a telephone number published by SunBiz Support.

Providing affirmative consent during a telephone call, consultation, or other interaction when verbal consent is permitted and properly documented.

Otherwise clearly asking or agreeing to receive text messages from SunBiz Support.

Your consent applies to the telephone number you provide and to messages that are reasonably related to the disclosure presented when you opted in. We may maintain records of the date, time, source, telephone number, disclosure, and method associated with your consent.

5. Automated Technology and Marketing Consent
By opting in, you authorize SunBiz Support and communications service providers acting on our behalf to send recurring text messages to the number you provided. Messages may be sent using an automatic telephone dialing system, automated platform, prerecorded or artificial technology where applicable, or other technology permitted by law.
Your consent to receive marketing or promotional text messages is voluntary and is not a condition of purchasing any property, goods, or services. You may purchase services without agreeing to receive marketing texts by contacting us through another available channel.

Providing your telephone number for service delivery may allow us to send messages reasonably necessary to respond to your inquiry, confirm requested actions, provide appointment or account information, or deliver other communications permitted by law. We will obtain any additional consent required for marketing messages.

6. Types of Messages You May Receive
Depending on your consent and relationship with SunBiz Support, messages may include:

Appointment confirmations, reminders, rescheduling notices, and consultation follow-ups.

Intake-form reminders, requests for documents, missing-information notices, and status updates.

Service-delivery communications concerning business formation, compliance, registered-agent service, business-address hosting, online presence, funding readiness, business credit preparation, or related consulting services.

Account, invoice, payment, renewal, deadline, filing, or administrative notices.

Educational tips, business funding-readiness information, event notices, service announcements, surveys, and customer-support messages.

Marketing or promotional messages concerning SunBiz Support services, programs, offers, or referral opportunities when you have provided the required consent.

We do not guarantee that every message category will be used or that text messaging will be available for every service.
7. Message Frequency, Charges, and Carrier Terms
Message frequency varies based on your interactions, appointments, service status, account activity, and communication preferences. Some periods may involve multiple messages, while other periods may involve no messages.
SunBiz Support does not charge a separate fee merely to receive our text messages. Standard message, data, and other charges imposed by your wireless carrier or service plan may apply. You are responsible for all carrier charges associated with sending or receiving messages.
Wireless carriers are not liable for delayed, undelivered, filtered, blocked, or misdirected messages. Message delivery is subject to effective transmission by your carrier and other communications providers and is not guaranteed.
8. Opting Out and Revoking Consent
You may revoke consent and stop text messages at any time. The easiest method is to reply STOP to a message from SunBiz Support. We also recognize clear opt-out requests, including replies such as QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, and other reasonable statements that clearly communicate that you no longer want text messages.
We will honor a valid opt-out or revocation request within a reasonable time and no later than the period required by applicable law. Automated STOP requests are generally processed promptly. After an opt-out request, we may send one non-marketing confirmation message acknowledging that the request was received and processed.
Once your opt-out is processed, we will not send additional text messages to that number under the applicable program unless you later provide new consent. Opting out of text messages does not cancel a consultation, service agreement, invoice, payment obligation, registered-agent engagement, business-address agreement, or other underlying relationship. We may communicate through email, postal mail, manually placed telephone calls, website notices, or other lawful channels as permitted by your agreements and applicable law.

If you subscribe to more than one separately disclosed messaging program, an opt-out request may apply to the program or number from which the message was sent. You may contact us directly to clarify or broaden the scope of your request. We reserve the right to apply an opt-out more broadly when appropriate or required by law.

9. Help and Customer Support
For help with the SMS program, reply HELP to a message, call 877-778-6249, email admin@sunbizsupport.org, or use the Contact Us page at www.sunbizsupport.org.
HELP requests may receive an automated or manual response with contact information or basic instructions. Text messaging should not be used for emergencies, urgent legal deadlines, sensitive identity documents, full payment-card information, passwords, or information that requires immediate action. Call us or use another appropriate communication channel for urgent matters.

10. Mobile Number Changes and Reassignment
You must provide a current and accurate mobile number. If you stop using the number, transfer it, lose access to it, or are no longer authorized to use it, you agree to opt out and promptly notify SunBiz Support. You may be responsible for consequences caused by your failure to notify us that a number has changed or been reassigned.
If we learn or reasonably believe that a number has been reassigned, is invalid, or is no longer associated with you, we may suspend or stop messages to that number without notice.

11. Privacy and Use of Mobile Information
Our Privacy Policy explains how we collect, use, retain, disclose, and protect information associated with our text messaging program. We may use your mobile number, message content, consent records, opt-out records, delivery information, and interaction history to provide services, respond to inquiries, document compliance, prevent fraud, improve communications, and operate our business.

We may disclose mobile information to communications platforms, hosting providers, consultants, professional advisors, and other service providers that process information on our behalf and are used to operate the messaging program. We may also disclose information when required by law, to protect rights or safety, or in connection with a lawful business transaction.

We do not sell or share text messaging originator opt-in data or consent with third parties for their own marketing or promotional purposes. Mobile information may be shared with service providers solely as reasonably necessary to deliver, support, secure, or document the communications you requested or consented to receive.

12. Links, Third-Party Services, and External Content
Messages may contain links to our website, scheduling pages, intake forms, payment pages, government websites, lenders, vendors, or other third-party resources. Third parties maintain their own terms and privacy practices. SunBiz Support is not responsible for the availability, security, content, products, services, or privacy practices of third-party websites or platforms.
A text message that references a lender, funding provider, government agency, credit bureau, bank, vendor, or other organization does not mean that the organization has approved you or that SunBiz Support controls its decisions.

13. Acceptable Use and Message Security
You agree not to use our text messaging channels to submit unlawful, threatening, abusive, fraudulent, deceptive, defamatory, infringing, malicious, or harmful content. You may not attempt to disrupt the messaging system, impersonate another person, transmit malware, harvest information, or use the program for unauthorized commercial solicitation.
Text messages are not guaranteed to be encrypted or secure. Do not send Social Security numbers, complete bank or payment-card numbers, passwords, authentication codes, protected health information, or other highly sensitive information by text unless we expressly provide a secure method and request the information through that method.
14. Changes, Suspension, or Termination of the SMS Program
We may change the program, message categories, sending number, service provider, short code, toll-free number, frequency, or these SMS Terms at any time. Material changes will be posted on our website or communicated as required by law. The updated SMS Terms become effective on the stated effective date.
We may suspend or terminate the SMS program or your participation for operational, security, compliance, fraud-prevention, carrier, legal, or business reasons. Termination of the SMS program does not affect rights or obligations that arose before termination.
15. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SMS PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SUNBIZ SUPPORT DOES NOT WARRANT THAT MESSAGES WILL BE TIMELY, ACCURATE, COMPLETE, SECURE, ERROR-FREE, OR DELIVERED WITHOUT INTERRUPTION. TEXT MESSAGES ARE FOR COMMUNICATION PURPOSES AND DO NOT REPLACE SIGNED AGREEMENTS, OFFICIAL GOVERNMENT NOTICES, LENDER DOCUMENTS, PROFESSIONAL ADVICE, OR YOUR RESPONSIBILITY TO MONITOR DEADLINES AND ACCOUNTS.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SUNBIZ SUPPORT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SMS PROGRAM, INCLUDING DAMAGES CAUSED BY DELAYED OR UNDELIVERED MESSAGES, CARRIER FAILURES, DEVICE ACCESS, LINKS, SECURITY EVENTS, MISDIRECTED MESSAGES, MISSED DEADLINES, OR RELIANCE ON A TEXT MESSAGE.
Nothing in these SMS Terms excludes or limits liability that cannot lawfully be excluded or limited. Any additional limitations, exclusions, or remedies in our general Terms & Conditions or a signed service agreement also apply to the extent permitted by law.
17. Your Responsibility and Indemnification
You are responsible for the accuracy of the number you provide, your authority to use it, your device and carrier charges, the security of your device, and your compliance with these SMS Terms. To the fullest extent permitted by law, you agree to indemnify and hold SunBiz Support harmless from claims, losses, or expenses arising from your unauthorized use of another person’s number, your unlawful use of the program, or your material violation of these SMS Terms.
18. Governing Law and Severability
These SMS Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent federal law controls. Any dispute is also subject to the dispute, venue, and other applicable provisions contained in our general Terms & Conditions or a controlling signed service agreement.
If any provision of these SMS Terms is found unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision or any other right.
